The Problem

As a foreign worker in Turkey, you may face workplace challenges including unpaid wages, excessive working hours, unfair termination, or discrimination. Many foreign employees are unaware that Turkish labor law provides the same protections to legal foreign workers as it does to Turkish citizens. How the Law Works in Turkey

The Turkish Labor Law (İş Kanunu, Law No. 4857) applies equally to all legal employees regardless of nationality. Key protections include: maximum 45-hour work week (Article 63), overtime compensation at 1.5x normal rate (Article 41), annual paid leave of 14–26 days (Article 53), prohibition of discrimination based on language, race, or nationality (Article 5), and protection against unfair termination (Articles 17–21). Foreign workers with valid work permits are covered by the Social Security and General Health Insurance Law (Law No. 5510) for workplace accidents, health insurance, and retirement benefits.

What the Tourist Should Do

Ensure you have a written employment contract specifying salary, working hours, and benefits. Keep records of all working hours and overtime. Report any workplace injury to SGK within three days. If terminated unfairly, you have 30 days to file a reinstatement lawsuit (işe iade davası) at the Labor Court. Document any discrimination or harassment incidents in writing.

The Risks

Foreign workers without valid work permits have limited legal recourse for labor disputes, though courts have recognized some rights even for undocumented workers. Losing your job may also mean losing your residence permit, creating time pressure to find new employment. Non-compete clauses in employment contracts may restrict your future job options in Turkey. Language barriers may prevent full understanding of contract terms and workplace policies.
